M&M Boys Demo Products LLC

Limited Warranty

M&M Boys Demo Products LLC (and/or its owners) warrants, to the original purchaser, (as stated on each purchase receipt), of this NEW M&M Boys Demo Products LLC fuel tank, battery box or transmission cooler, against defects in material and workmanship, as determined by M&M Boys Demo Products LLC (and/or its owners) for the period specified below. M&M Boys Demo Products LLC’s warranty commences from the DATE OF PURCHASE, (as determined by the date on each purchase receipt) as recorded by M&M Boys Demo Products LLC.

Standard Catalog: Welding/ workmanship 1 Year from date of purchase

Custom Designed: Welding/ workmanship 6 Months from date of purchase

Parts/Products/Items: Anything purchased No Warranty unless given by original manufacturer

By M&M Boys Demo Products LLC for use in the assembly of their products or for products purchased for re-sale

M&M Boys Demo Products LLC (and/or its owners) assumes no responsibility or liability for damages or injuries which may result from the use or installation of its products, whether or not properly installed or used. Due to the nature of the products manufactured and/ or sold by M&M Boys Demo Products LLC and the extreme demands on racing/ demo derby and performance products M&M Boys Demo Products LLC products are sold WITHOUT ANY EXPRESS WARRANTY OR IMPLIED WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR INTENDED PURPOSE.

This warranty shall not apply to a product or component or accessory which has been subjected to accident, negligence, disassembly, alteration (including, but not limited to, improper or faulty repair) abuse, misuse (including, but not limited to, incompatible fuels or additives), and improper installation (including, but not limited to, use of unauthorized parts or accessories), or unsuited uses. M&M Boys Demo Products LLC (and/or its owners) SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, CONTINGENT DAMAGES, EXPENSE OR INJURY ARISING FROM ANY DEFECT IN ITS MANUFACTURED OR SOLD PRODUCTS, OR FROM THE USE OF ANY OF ITS PRODUCTS, DEFECTIVE OR OTHERWISE. Any warranties implied by law are limited to the duration of this warranty.

All warranty claims hereunder shall be made by contacting M&M Boys Demo Products LLC and first obtaining a RM# then returning the M&M Boys Demo Products LLC product, shipping prepaid, together with the original invoice and a full written description of the alleged defect to M&M Boys Demo Products LLC, 512 1st Street NW, Dodge Center, MN 55927. Mark shipment with the RM number. M&M Boys Demo Products LLC will, at its sole option, repair, replace or prorate credit that amount against a replacement product, for the original purchaser, when M&M Boys Demo Products LLC’s examination shall disclose it is defective in welding/workmanship and providing it has been returned to M&M Boys Demo Products LLC within the time period as specified above. Products older than 60 days will be prorated at a straight ratio based on the number of months left on the warranty, products returned with 60 days will not be prorated.

M&M Boys Demo Products LLC reserves the right to make changes in its products at any time. Product refinements or alterations will be made without obligation to change or improve products that were previously manufactured. This warranty gives you specific legal rights, and you may also have other rights which vary from jurisdiction to jurisdiction.

Warranted products will be returned to the customer pre paid via UPS Ground Service within the USA.

THIS WARRANTY AND THE RIGHT TO REPAIR OR REPLACEMENT OF DEFECTIVE PRODUCT OR CREDIT OF THE PRORATED PURCHASE PRICE ARE THE BUYER’S SOLE AND EXCLUSIVE REMEDY AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED.

ASSUMPTION OF RISK: It is well recognized that demolition derby/automobile racing is a very dangerous activity. Even with the utmost of care, demo derby/racing involves certain unavoidable risk. Persons using M&M Boys Demo Products LLC products and accessories manufactured or sold by M&M Boys Demo Products LLC, ASSUME THE RISK inherent in this type of activity.

LIMITED WARRANTY/DISCLAIMER: M&M Boys Demo Products LLC will repair or replace, at its expense and at its option, any M&M Boys Demo Products LLC manufactured products as stated on our LIMITED WARRANTY page, provided the original purchaser notifies M&M Boys Demo Products LLC of the alleged defect within sixty (60) days of purchase, adhering to the procedure as stated on our LIMITED WARRANTY page. This warranty does not cover normal wear and tear. M&M Boys Demo Products LLC (and/or its owners) will not be responsible for any asserted defect which has resulted from misuse, abuse, repair, or alteration made by anyone other than a representative of M&M Boys Demo Products LLC. Under no circumstances will M&M Boys Demo Products LLC (and/or its owners) be liable for incidental or consequential damages resulting from defective products. This warranty is the sole warranty of M&M Boys Demo Products LLC and sets forth the purchaser’s or user’s exclusive remedy, with respect to defective products. All other warranties, express or implied, whether of merchantability, fitness for purpose, or otherwise, are expressly disclaimed by M&M Boys Demo Products LLC.

WARNINGS

1. ANY modifications of M&M Boys Demo Products LLC products may result in failure of the system.
2. ALL M&M Boys Demo Products LLC products and accessories should be inspected by the purchaser or user upon receipt of said product and prior to each use, to insure proper working order.
3. Lack of PROPER MAINTENANCE may result in failure of the system.
4. All M&M Boys Demo Products LLC products and accessories should be INSPECTED YEARLY by the purchaser or user for any cracked, worn, torn or damaged materials such as gaskets, hoses or connectors and is the responsibility of the purchaser or user to replace said materials immediately.
5. Do not use sealant on gasket surfaces.

ANY FAILURE IN AN M&M Boys Demo Products LLC PRODUCT SHOULD BE REPORTED TO M&M Boys Demo Products LLC IMMEDIATELY. THE PRODUCT MUST NOT BE USED AND SHOULD BE RETURNED FOR INSPECTION IMMEDIATELY.
